“We came to the Manning Law Office in July 2009 with a mortgage we couldn’t afford (first with B of A and second with Flagstar). He worked with BofA for more than a year and BofA wouldn’t budge. But Joe didn’t give up (and neither did we). Then the second mortgage decided to file a lawsuit and get a judgment. Joe explained that under the One Action rule in CA, once Flagstar got a judgment, the Deed of Trust securing its debt would effectively go away allowing for a discharge of the secured debt in a Ch 7 bankruptcy. Once the judgment was entered Joe immediately filed the Ch 7 BK for us. Simultaneously, B of A approved the loan mod!
